This article is explaining how companies can turn their punitive damages into federal tax and defeat the purpose of the penalty. The article then explains how there is another approach to this problem. The jury should be aware that the punitive damage they put on the company will be turned into federal taxes, so the jury should make the punitive damage very high, hurting the company financially. Congress is also trying to pass a law that punitive damages can not be changed to federal taxing. I think that court cases like these can be very hard to please everyone.
